We don't know the details and it is always possible that the kid unclipped it or was wearing it improperly. But yes ... wear your seatbelts.

It’s easy to sit in a safe, warm spot and find all the faults someone else made, to make yourself feel like it could never happen to you. Guarantee the person driving the van with the child didn’t think their child would die last night. Plus, the unrestrained part is second hand info at this point.
