It doesn't matter. If they are marketing and selling a product using Apple's trademark and copyrighted design elements, no matter the volume, Apple can sue the hide off their backs. In this particular case, however, it goes well beyond a contestable infringement which is often handled in a civil court. In this particular case, however, it's a clear act of counterfeiting, a criminal offense punishable by fines and imprisonment.
