A woman tried to rescue ducks on a highway here once and ended up killing a motorcyclist and his teenage daughter because she stopped her car in the left lane of a highway. She was found guilty of criminal negligence and dangerous driving causing death.

The lady in this video stopped on the shoulder.

The lady in your story stopped in the left lane which is illegal.

Separately, I don't know why the people in the above video are slowed in the left lane, that is dumb. You don't have to slow to a bear stop just because someone is on the shoulder.

If you break a law and cause damage that is a good case for negligence. Since you intentionally didn't do the standard thing people do (ie, take the necessary and reasonable steps to avoid damage).
