I was given multiple field sobriety tests and a breathalyzer test. (I blew zero cause i had not been drinking and the officer threw the plastic piece on the ground) The police report claims no field sobriety tests were given.

Update: I was driving on I5 back from Portland OR Thanksgiving night after visiting family. I was headed to Kitsap county area, either to my job (late shift) or home - depending on traffic and how much time I had.

I was running low on gas, pushing my limits and somehow missed my exit right in Tacoma area on I5, kinda by the Tacoma dome. I then got back on I5 but going (South not North)

I could feel my car running low on gas. With the city traffic I had floored it trying to get on 16(was taking the tacoma narrows bridge towards kitsap) at the last second.

I had ran out of gas right there. Off the road kinda in the ditch in front of a lightpole and damaged curb (previous damage from someone else, Google Maps even shows it)

I was able to prime the fuel pump (cycle the key) when i was able to restart the car for like 3seconds i floored the gas and just dug in the dirt.

An ambulance showed up asking if I was alright... they leave... a cop shows up and leaves cause I just called AAA for gas.

AAA shows up, freaks out about the pole being down and blames me- even thought i hadnt hit it. The police are called and two arive- the same cop as before along with another.

They questioned me about what happened and acted as if i was lying and runing out of gas. The cop from before then gave me multiple field sobriety tests. After blowing a zero (i had not been driking) he threw the plastic piece on the ground.

I was given an exchange of info (mine info and the DOT- due to curb damage which wasnt even caused by me) and a ticket for negligent driving

This definitely a huge flag.

Unless they specifically have an accident "report" that only details facts about the accident. But doubtful. I am not sure who to bring this up to, but is not a good sign.

The best advice is always Don't talk to the cops, ever

If they call you in for more questioning, say no. Say you'll only discuss with your attorney present.

And for the love of FSM, get an attorney. Sounds like you are about to enter the human meat-grinder that is our legal system, and without representation you will come out the other end poorly. And relying on whatever rando's on the internet suggest will not be in your best interest.

The officer is a Washington State Patrol Officer. Theres more to the whole story but I'm not going to put my personal info out here. This was in Tacoma, Pierce County WA late November, my court date is in 2023

Request WSP provide dashcam footage from the officers vehicle. It should show the field sobriety tests being performed.

Get a lawyer, file a request for dash and body cam footage of the incident.

If you can catch a cop in a lie you have a good chance of them dropping all charges. Better yet, if you catch a cop in a lie it brings doubt about all the previous cases they’ve been a part of..

I had the WSP falsify a recovered stolen vehicle report because they let go from their impound yard before the towing company bill was paid. They fucked up then filled out a report after the fact. These guys have some huge credibility problems.

Are you taking about the coding on the accident report or something written in the narrative? The alcohol coding on the report refers to chemical tests (breath, blood) after a DUI arrest is made, not roadside sobriety tests.

Maybe not every cop is out to murder, rob, rape, and/ or ruin the life of random innocent citizens, but the many that will do will have a harder time if the lawyer does the talking and the citizen excerizes their 5th A

As for the accident a accident report was filed but no accident happened. ( I just updated my post)

Yes, agreed. That comes directly from legislation passed the Progressive left Democratic party. This is a one party state and the Dem's are going to have a hay day the next couple of years passing these kind of laws.
