There is hamburger on the menu, so they have a picture of a burger. Thats a pretty normal thing to do. Also, hamburgers were invented long before SpongeBob. So, a krabby patty is made to look like a burger.

How to tell whether or not a company actually officially lisenced their marketing photos. Because they have to either buy them, or pay for the rights to use them for business purposes. At least in the US. If you don't have the rights to use the pictures, they can sue.

They could, but what benefit would they have in extracting a small amount of money (relative to the wealth of the entertainment industry) from a business in a completely unrelated field?
This sorta thing is very common, and rarely do the copyright holders take action, unless large amounts of money start being involved.
A mom and pop bakery is of no concern to them, even if they're legally in the wrong to use the image without consent
