I have 15 days to report the accident.
Should have reported at the scene of the crash. ALWAYS call the police to have an accident report filed. People's good faith will rarely payout in the end.
Reddit is not legal counsel. Talk to a lawyer/ attorney and stop trusting the internet to solve your problem.
Yeah and you had about 15 minutes for the cops to come and see that he was smoking weed and that he was at fault.
Geez, that's rough. If you have all the information and they are trying to skip out on you, you could try contacting the business considering it was a company vehicle. They may even offer to help you go after the employee if the employee tried to hide the accident from the owner too. I dont know if you forgot to include it or if they didnt provide it, but a picture of the company vehicle registration should have the insurance info if its a Massachusetts registration. If your vehicle is messed up, you shouldnt have to be the one pay to get made whole again.
Notifying the police of the occurrence is always a good thing. Just so there is a record created somewhere that you reported what happened.
Side note: unless he was carrying over 2/3 of an ounce of cannabis, it wouldve only been a ticket and confiscation, if he was smoking while driving thats still a dui though.
Good luck, i hope that the other driver gets back to you and you dont have to fight much to get fixed!
Always. Even a little old lady 100% at fault will lie to her insurance company to avoid paying out to you.
You’re already aware that you have handled this in a few different ways that will make it hard for you to get relief legally. If you remember the name of the company on the work van, I would try to contact someone higher up there. They probably want to know why their van was damaged and if their guy was high on the job.
Or it could be it was the owner / owner’s nephew driving the van.
Oh man. I'm going to probably be unpopular here, but. You both left the scene of a crime. Anything both parties determined after the crime began, was pretty null I'd say. He messed up, you got damages. You both fucked up. But YOU not calling then and there, puts you now, not only at fault an further, but also guilty of enabling someone who committed a crime, under the influence, regardless of substance. To, go on with their day, To do whatever they pleased. Cause another wreck. Backpedal on his sketchy 'never gonna pay this guy back' plan. You were never going to get a cent unless his insurance had been informed of the accident from the police. literally anyone is going to ask why you didn't just call.
2 other things. Why on earth would you have not called the police if there was in fact a notable amount of damage and impairment? Why would you try to "collect" on it now in anyway? I'm just curious is all. I've been in accidents in life. At fault, and on the receiving end. The only reason to not call in an accident in NH, especially with a rear-ending, when you would have won. 100% especially with them having Mass tags. Would be. That maybe there was more to the whole story? Just curios is all. I'm all for shitting on Massholes and pricks that ruin it for other Marijuana smokers. But, what's the whole story please. Just seems," 'account suspended' message on a 'new ps5' to me." Sorry if I offend, truly. I just really would like to know. I've been in a bunch of aspects of this situation and am happy to reply or comment
You left the scene of an accident. When you did that, you went from one guy clearly being wrong, to there being two guys who are clearly in the wrong.
Bite the bullet and call the police in the justification where it happened.
We need to ban high capacity assault bongs. NH can’t afford anymore senseless bong violence.
Be nice to us Massholed please. We prefer you say" those Massholed from taxachussett.thanks
Why wait?
Why ask all the not-attorneys in a niche subreddit?
From Mass. Can confirm 👍 What's crazy, is I've always known Mass as Taxachusetts. Being in Vermont these last few years though, I feel like they are running for that title.
Oh, wow... so much wrong here.
No call to the police with a rear-ender possibly caused by impairment? Ouch.
Looking for payment methods just a few hours later, almost certainly before he's had a chance to go through the reporting process with the police, his employer, and his employer's insurance? You expect reading your "hours later" texts aren't likely to be the top priority in his life?
You realize that insurance payouts can take weeks or months while the insurance companies and their lawyers work things out, right? Never mind that they wouldn't know how much to pay out until you've gotten your damage estimates.
You obviously have a rather delusional idea of how long it takes to go through the process. When my wife got rear ended about a decade ago it took well over a year for the game to be played, which involved ignored letters, court dates, and even the other driver having a bench warrant issued.
Payment details arranged within hours... riiiiiiight.
It's gonna be an up hill fight. My bro works corporate safety and company vehicles are often targets for people looking for a pay out. If you had a police report you would be fine no police report burden of proof is on you.
Lol “or it could it be it was the owner / owner’s nephew driving the van”
Just the owner or his nephew?
Call the cops now and get a lawyer asap. Get a copy of the police report and go to the hospital. He will get away with the possession charge but his company will pay for everything dont be stupid just put what he said to you in the police report.
This is exhibit A.
Reach out to Portsmouth PD ASAP to get a report filed and provide all the info you have on him. If he didn't get back to you after two attempts then I'd reach out to his company with a simple "your man hit me in your car" and give them an opportunity to make it right.
If no love then I'd consider lawyering up if that's a road you want to go down.
…. Yikes, how to people actually get by in day to day life when making decisions like this.
You lose a lot of credibility waiting.
Tough lesson. If you can’t afford insurance, that’s who needs insurance. Call the cops, but you created a decent headache for yourself.
Insurance on my late-model vehicle costs about $500 a year. Liability, collision, comprehensive, non-insured motorist, the whole shebang. Yeah, it is a bit of a scam but not so much last year when my windshield got busted.
Why on God's Good Earth do people drive around without having insurance on their motor vehicles?
Which is super ironic as Massachusetts has one of the lowest tax burdens in New England.
I thought Mass was a no fault state.
The accident occurred in NH
The police are not going to file a crash report if you both left the scene, let alone more than a day later. You can fill out a self report accident form and mail it to the DMV to get that process started.

If I remember, it doesn't matter to them.
How are you going to afford a lawyer if you can't afford car insurance?

By calling the police when you were rear-ended.
