More punishment for reasonable self-defense. This city really needs the Batman.

> Earlier this week, a judge declined Bragg's request to downgrade the charges from murder to manslaughter—because prosecutors once again did not bother to furnish evidence of her domestic abuse. That evidence includes a 2009 police report detailing Murray's arrests, written correspondence from 2018 in which Murray admits to physical abuse, and a 2019 video of a naked, intoxicated Murray attacking McCarter.

> "They affirm, without reference to exhibit or documentation, that she is a survivor of domestic violence," wrote Acting New York State Supreme Court Justice Diane Kiesel. Again, that's not because those exhibits don't exist.

The prosecutors really need to explain themselves

The case sounds like reasonable self defense. Llaw enforcement on the street barely do their job and the ones in office will punish citizens who defend themselves harder than they go after career criminals. What a place to live..

It's kind of bizarre that our fake-progressives suddenly act tough-on-crime whenever someone is acting in self-defense.

In their world it makes total sense.

Black guy was killed. The killer didn't take into account his lived experience or systemic racism. Ergo it is murder and not justifiable homicide.

Yes, but her suffering as an individual does not outweigh the suffering of an entire race of people that caused his misbehavior.

You can't make this shit up.

LOL Bragg's office is so incompetent.

They tried to downgrade the charge to manslaughter by citing her being a DV victim, but somehow forgot to include voluminous evidence, spanning back over a decade, supporting this assertion.

Also, as another comment noted, why is it that Bragg's whole "criminal justice reform" shtick seems to not apply to seemingly valid claims of self-defense?

You can always count on Braggs office to serve justice for the victims!

Didn’t he claim he was gonna dismiss the case against her when he was running?

I don't know if it should be murder or manslaughter, but that's the problem with politicians that run on cases they aren't familiar with. Now Bragg's got to backpedal and try to downgrade to manslaughter but doing it, perhaps intentionally, poorly.

And it just looks like a giant clusterfuck.

WOW -

>McCarter was arrested in March 2020 after stabbing her husband, James
Murray, who reportedly entered her home, where he did not live, heavily
intoxicated, and allegedly threatened her life. She was found trying to
administer CPR while screaming for assistance, and her neighbors say
Murray had been on a bender in the building. But the grand jury that
approved a murder charge against McCarter didn't hear
about Murray's drunkenness that day, or his detailed history of violent
behavior and abuse, because prosecutors declined to share it.

NYC already operates like Arkham Asylum. With the way they just let violent criminals roam free.

Oh you randomly slashed a person on a subway platform with a knife for no reason? That sounds like assult with a deadly weapon.

But any way your free to go. You better hurry you don't wanna miss the train!

To be fair Adams is a former cop.

So he probably doesn't have an issue with domestic violence. Considering 40% of cops abuse their families.

You gotta make an example of the uppity ones who talk or fight back against your abuse...cop logic.
