I live in New York, but I was born and raised in Germany. That you can sue somebody for tripping and falling is one of the greatest mysteries to me. Feels like you were to stupid to pay attention and now want somebody else to pay for it.

Don't get me wrong, in this case she should get the money.

Home owner insurance would cover it. But you have to sue first

A homeowner shouldn't be responsible for what happens on a municipal sidewalk they don't own.

You might not own the side walk, but landlords are responsible for the cleanliness and safety around their property, including the sidewalk

I know that’s how it works but it’s stupid and there’s nothing a landlord can do about tree roots. You aren’t even allowed to do anything near a tree without paying an arborist to keep a watchful eye. It’s no wonder people go around kill trees when nobody is looking.

I’m assuming if there are tree roots, landlords have to call some number (311 maybe?) to report the issue and have the city deal with it.

Maybe that’s why dB got brought into it, if he didn’t call the city to report the issue to begin with, maybe he’s also liable

In NYC, the home owner has to maintain the sidewalk in front of their property.
