If BdB was complaining to city regarding raised sidewalk then its most likely due to tree roots. City is on hook to fix it if its tree related. If true, lady suing the wrong person and not the bigger cash cow.

A decent human being who has much more money and clout than she most likely does would pay for her dental work and get whatever agency is responsible to fix the pavement so no one else gets hurt. But she's not a carriage horse.

It's one single suit with BdB and both city agencies as defendants. Their lawyer probably thought, quite reasonably, that it's simplest and cheapest and therefore best to include all potential defendants where someone could make a plausible nonargument that they should be included for a legitimate non-frivolous reason, even if that argument ends up not winning in court. It prevents DOT or Parks Dept from making the lawsuit slower and more costly by blaming each other and/or BdB and insisting that they be served and joined before resolving the lawsuit.

Also, as a realpolitik practical matter, including BdB in the lawsuit probably helped get the NY Post especially interested in writing about / highlighting her story, which will add pressure on the city to fix the sidewalk faster than otherwise - maybe the extra pressure will get her a quicker and/or better settlement too. The Post quotes her criticizing how BdB ran the city for eight years, and they love to run anti-BdB quotes.

Many years ago before Jury Duty reform (sometime in the 90s) I got called for Jury duty many times and so did voir dire (where you are interviewed as a prospective juror) a LOT and I swear about 50% of cases in civil court were trip and fall lawsuits and at least IMO they all seemed fishy.

I live in New York, but I was born and raised in Germany. That you can sue somebody for tripping and falling is one of the greatest mysteries to me. Feels like you were to stupid to pay attention and now want somebody else to pay for it.

Don't get me wrong, in this case she should get the money.

I’ve walked by his house before, and I want to say if you’re tripping around there, then it’s because of your own big dumb feet. (Been a while since I’ve last passed by there, maybe a tree’s roots got real big since then).

I know that’s how it works but it’s stupid and there’s nothing a landlord can do about tree roots. You aren’t even allowed to do anything near a tree without paying an arborist to keep a watchful eye. It’s no wonder people go around kill trees when nobody is looking.

I’m assuming if there are tree roots, landlords have to call some number (311 maybe?) to report the issue and have the city deal with it.

Maybe that’s why dB got brought into it, if he didn’t call the city to report the issue to begin with, maybe he’s also liable

In 2003 responsibility and liability shifted from the City to the adjacent building owners of the sidewalk, because of Bloomberg.
But DeBlasio's property would be exempt because one, two, or three-family homes are as long as they are occupied by the owner and are used only for residential purposes.
