What happens if a drunk person has the engine on to stay warm, but is sleeping in the passenger seat? Could they still be arrested for a DUI?

Yes, I'm pretty sure that possessing your keys while being in your car is a DUI.

Cops can do whatever they want and arrest you, but I bet you could get out of that one in court.
