Because when you pull over and let your friend get out to rob and kill a guy, you're officially a piece of shit too and should be prosecuted. I believe that's a direct quote from the criminal code.

To give you a more dispassionate response, no, murder is different. If these two were involved a crime and one of them commits a murder in the process of that crime, both can be charged with murder.
