there's a not particularly good colourised version of it kicking about, saw a couple of clips of it on youtube. was not impressed.

Are you looking for siege moves where folk are trapped and the monsters are outside?
Try Attack the Block, The Void or Legion
Or are you looking for movies where folk are trapped inside a space /with/ the monsters?
Try Crawl or Blood Red Sky.
A couple that are just outside your criteria due to the age of the film, the Blob remake from 1988, Demon Knight, Dusk til Dawn. And Green Room which has /all/ the hallmarks of a seige horror film, but it's tone and content marks it more as a thriller.

Not just that, but if it does go to court it'll be joeshmo and whatever level of lawyer they can afford vs nintendo's legions of trained ip lawyers.
You'd need to have an airtight legal arguement to even make a dent and even with that airtight arguement, nintendo can afford to drag the case out to the point where joeshmo's bankrupted by the legal fees.
